In March, and in the wake of the iiNet Full Federal Court appeal decision, the IIA announced it would move to develop a code of practice for internet intermediaries to provide clarity and guidance on rights and responsibilities relating to potential authorisation liability.


The goal is to provide industry guidance of safe harbour eligibility and is undertaken in tandem with IIA’s efforts to broaden the legislative criteria for safe harbour eligibility which is currently restricted to carriage service providers in Australia.


The IIA Copyright Code Development Group delivered a submission in relation to the issues paper  “REVISING THE SCOPE OF THE COPYRIGHT ‘SAFE HARBOUR SCHEME’” to the Federal Attorney-General's Department on the 22 November 2011. The submission can be viewed here
